Totaled/but not

I have a 08 duramax with 32 k mikes like brand new and 8k in addons. Went to shop for hail damage and body shop got water in cab causing issues. No dealership will give estimate due to it being a water issue. Ins. Is gonna total, but I will not give up my ride. Awaiting call as to what they will pay. Similar trucks with mostly same options are at 43k to 49k most higher miles than mine.once attorney realized ins. Co. Is gonna total he no longer wants to Perdue a suit against the idiots at body shop and thinks I should let ins. Total and buy back for salvage. The truck still looks nearly new and other than 2 computer errors on readout it runs flawlessly. What can I do with my ins. Co. To keep my truck with a good title and not have it sent in to DMV as a total. I don't want total price and keep truck at salvage price and clean title. I just want my truck and enough to put it back as it was before idiots tore it up. Being a water damage and no one giving a estimate makes this a really grey area. Any input from you ins. Folks would be great. I will not give up my ride.

My recommendation is what to see what happens... and then ask a question if there are any. Otherwise we are just guessing a million different possibilities... which is pointless.

Already got confirm from ins. That they are totaling. Got call from car auction to see if the truck is ready for pick up. (You know I told them he'll no)

If it's at a location where it's incurring storage then the insurance company will stop paying for those charges very soon (if not already). You can feel free to leave it there and pay for storage or have it moved to a storage free location.

Is it at the dealers location who damaged the vehicle? If so and they had the nerve to charge storage, I'd certainly have words with them.

Truck is in my possession. It spent 11 1/2 weeks at 2 different Chevy dealers. The short is now fixed after about 4000 in repairs that warranty paid for most of. Body shop paid for some. I am still driving the truck. It will not leave my possession regardless of outcome.

There was never a need for an attorney. What was he going to sue for? He gave you an appropriate answer. Your beloved vehicle will be reregistered as a "salvage" and you'll have your ride.

Your argument, apparently, concerns the value of the vehicle. You can argue that one until to get the answer you like.

Why would this be a "warranty repair" at all? Original body damage due to hail, additional electrical damage possibly due to negligence . . . neither of those are warranty claims. Sounds like another example of insurance fraud to me.

The ins. Claim was hail damage. Only claim I've ever filed in my life. The body shop that caused damage took truck to dealership and gave my info and it was turned into my ext. warranty co. It was body shops responsibility to pay but let warranty co. Pay. After nearly $4000 was paid and short still not fixed dealership found main drivers door switch to be water caroused and causing the short. Warranty co. Was told that and refused to pay so body shop payed that part. Then short was gone and truck went back to body shop. Body shop replaced 2 interior panels they damaged and buffed out some deep scratches in bedside to hide them and said they were done. Entire truck was painted aside from 1 door, top of cab, and behind cab. It has small scratches down 1 side of bed, a large run on other side if bed, clear coat is dry and cracked around 1 door window area,pieces missing in cab like around elec. sunroof,trim piece in ac vent ect ect. The attorney was for making body shop repair what they did to truck. But after no dealership would give me a appraisel to repair elec. issues that are on dash readout dealership advised to turn it in to insurance. Ins. Now wants to total cause can't get a appraisel. No ins. Fraud in any way. I want my truck no other and no money for my truck. Ins. Co. Will recoup their money back from body shop.

It seems your real issue is that you want to be a good amount for the truck, have a slight deduction taken for salvage and keep the truck. So I'm not seeing any issues at this time. You say you don't want the carrier to report the truck as a total to the DMV and have the title changed. How can anyone here help with this when we can't control it and you don't even know if it will be done?

You need to cross these bridges when you get to them. Advice can't be given on a million different possibilities.

I suspect the real issue you have is that you know the money paid out on the truck might not be able to put it back into the same condition is was prior to the loss. Your insurance companies agrees with that.... this is why they are going to pay you the value of the truck.

I was contacted today with some #s a little low but a respectable offer. More than I thought they would offer. Probably about 3 to 4 k low. Where I feel they were way off is the salvage buy back price was around 33% of total truck value, I'm understood that 6 years old and newer it takes 80% minimum to total so trucks value should not exceed 20% this is a 6k difference.why would this be the salvage buy back??? I agreed to sign papers stating truck could never be turned into ins. On a elec. issue claim that was a result of water, and I would give all info, pictures, text from dealership that shows body shop is liable for damages so my ins. Co. Can get their money back. SUPOSE to check with his supervisor and get back with me. Thanks for everyone's reply's.if anyone knows why the salvage buy back could be so high please share your thoughts. Also do any of you ins. Folks out there see it as possible for them to let me keep my normal title not a salvage if I sign their paperwork and provide them with all info. To help with them getting their money returned? The insurance company should have obtained bids on the salvage. Ask for that information and contact those companies to confirm they would buy the salvage for that amount.

Usually an insurance company totals out a vehicle when the cost to repair is 80%. But this has nothing to do with the salvage value. The salvage value is really not considered when determining if a vehicle is a total loss.
