Charged with hit and run. Please help!!

I’m being charged with hit and run - moreover with no license. Even I didn’t have any insurance at that time. My court hearing has been scheduled on October 2. Do I need an attorney? Also, am I eligible to get a continuation or extension till I get an attorney? Or, would the court appoint one for me if I fail? As per the police officer, the damages were not major ones. I don’t have the individual’s info who I hit. Otherwise, I’d have done an outside court settlement by now. What should I do?

Anyone having any experience?

Any particular reason you needed to be behind the wheel of an automobile on that occasion? The majority of responsible adults and eligible teens in the US operate a motor vehicle with a state-issued driver license, and the majority of them also pay for auto insurance. You apparently believe the law does not apply to you.

Only a criminal needs an attorney. If you still believe you did nothing wrong, then you must not be a criminal and do not need an attorney.

Also, am I eligible to get a continuation or extension till I get an attorney?

You would have to appear in Court on Oct 2 and ask the judge, nicely, if you may have a continuance. He does not have to grant that to you because you've had enough time to obtain one. But if you are not a criminal, you probably don't need one. You just tell the judge that you are not a criminal, and perhaps he'll let you off with a warning. Judges here in CA do that all the time.

If you fail what? The test to have a driver license? The ability to operate a motor vehicle without causing a collision? The ability to remain at the scene of a collision you caused? I think you already failed those tests, which I why I think you are a criminal.

Whether you are a criminal or not, you should have listened to your Miranda warning: 1) You have the right to remain silent. If you give up that right, anything you say (or write) can and will be used against you in court. 2) You have the right to have an attorney present during questioning. 3) If you cannot afford an attorney, one will be appointed for you at no charge. 4) Do you understand each of these rights as I have explained them to you? 5) Do you wish to waive any of these rights?

It appears that you have waived the right to silence. You apparently did not have an attorney present during questioning. And if you cannot afford an attorney, one will be appointed for you at no charge. You must contact the local Public Defender sometime prior to Oct 2 and see what they can do for you. You should not have waited this long.

Below are few acts that are deemed as misdemeanor and criminal:

1) Driving in roads without a license.
2) Failure to report an accident to police.
3) Failure to exchange information after an accident.
4) Driving on a suspended license.
The law is actually more harsh for those who hit and run than a DUI crash.

Not a criminal offense if there are no injuries or deaths.

3) Failure to exchange information after an accident.

Not a criminal offense..

4) Driving on a suspended license.

Criminal conduct.
