sold my van to a friend on payments an at the time she couldn't afford to tag it an ask me to leave it in my name till after it was paid for an I agree to it as long as she kept insurance on it till it was out of my name an she said she would .she had the van for maybe a little over a month an half an I get a call from her saying my van was total an her boyfriend an granddaughter an her son was in it .they were on a highway going to drop her son-in-law off in another town an the roads were iced over an a car hit them .an I said plz tell me it had insurance on it an she said it didn't. an then instead of them asking me to go with to get this settled they took upon there selfs to go an get a lawyer by thereselfs an now there wanting me to sign off on the title an I ask if they had the police report yet on it or if anyone had went an did an adjustment on it she said they haven't got it yet .an I said how do u know whos at fault then or even if the guy that hit them had insurance an she said they don't know yet that the lawyer was just wanting me to sign off of title an im not doing that I feel were neither one ending up with the van so we should have done it together so we both got some of our money back out of it an she still owes me on it .but since she didn't do what I ask im not just settling for whats owed on it.an theres no guaranteed of whos fault the wreck was yet .an I feel if im gonna get in trouble over this if it comes out it was her boyfriend fault then we are all gonna deal with it not just me....just don't like being lied too an I feel betrayed by her.for not worrying about what it would cost me if it was his fault. so what do I need to do....

So a "friend" tells you that they can't afford to even register a vehicle and for some reason you believe that they can (and will) pay for insurance. Yeah... I saw that from a mile away. I'm guessing you wrote up a good contract explaining in detail the terms of the sale and who was to maintain insurance on the vehicle... right? Of course you did not.
I fail to see why this attorney wants you to sign over the title. This does not make any sense... unless the attorney wants to see his/her clients get paid for the van that you still own. Basically, they take the money and you are left with nothing. Bad situation gone worse. I'd recommend that you call this attorney and ask why you'd sign over the ownership of the van if they still owe money and not it's damaged. I'd _not_ speak to this "friend" about the matter... the one that screwed you over all ready. Who owes the van is that party that could be held liable though. But if your friend is at fault then the attorney can't get paid so he/she would drop the case. But in that case the other party may be able to come after you as the owner the van. But even signing over the title after the accident won't change this as you owned the van when it was in the accident.
Speak to the attorney and find out why he/she wants you to sign over the title. It does not make sense.

I agree with tcope. But I would suggest that you find a different attorney.
Hopefully, and expensively, you have learned a lesson from this experience.

The attorney is not representing the OP, the attorney is representing the "friend" who was buying the vehicle and was in the accident.

A word to the wise. If you plan on selling a vehicle, unless you are a BANK, don't try to be a bank. Get payment in full before you release the vehicle.
As tcope said, a person who cannot afford to register a vehicle is less likely to have the money to pay for insurance, let alone gas for the tank. Why such persons even need a vehicle is beyond comprehension.
But I bet they have plenty of money for beer and cigarettes and cell phones.
It's a matter of priorities.
