My lawyer is trying to end my car accident case to receive his payment even though I still need to continue treatment with the hospital and is not yet ready to be discharge. I felt that my lawyer wanted to end this so he can end the case just to receive his payment. If I want to change my lawyer will I be charge for any fees?

Most likely, yes. You sign an agreement with the attorney to pay him/her part of your settlement. If you drop the attorney now he will assert a lien on any settlement that you are paid.

You suspect your attorney is just looking for a payment and not looking out for your best interest? Say it ain't so.

Your attorney cannot settle without your approval.

Your attorney, as tcope stated, must have your consent to settle a case. Ethically, he/she must place your best interest above his/her own -- anything less, and the attorney could be disbarred.

You may change attorneys at any time, but you will be obligated to pay them for whatever "investment" of their time and effort has already gone into the case . . . unless you have proof that they have misrepresented you or have acted unethically, or failed to properly and adequately represent you in the matter.
