I was hit by someone who ran stop sign and I did not have on

Driver ran stopsign and I did not have a stop. My dominant arm was broken in 2 spots which required surgery with a plate and 10 screws. I am a nurse so I was not able to work 6 months and my arm still hurts constantly.My MD said it may be a year or longer to get use back.His insurance took full blame and he only had 15,000$ coverage and I had under insured of 15,000$,My surgery was 41,000$ and my take home loss wages was 35,000$, My lawyer says he has nothing to sue for and that I am just out of luck because we can not sue..
