Former Agent unsure how to proceed with injuries

Hello. I am a former licensed PC and Health agent and was recently involved in a minor accident resulting in around 600.00 PD but more serious injuries.

I had turned into a parking lot and as I was approaching a drive thru, a car driven by an elderly lady began to BACK UP quickly. I slammed on my brake and put my car in reverse to attempt to get away from her but she still hit me. We both are STATE FARM clients and liability has been established. Repairs have been completed and I made verbal statements reflecting my actions to get away from her or physical damages would have been greater.

I did not receive medical care at the scene and did call the police even though it was on private property for an incident report.

Less than 24 hours later, I woke up and had complete numbness from my right knee down including my foot. I thought it had fallen asleep but continued to persist. I called State Farm, made a statement and opened up a MED PAY only claim on my side since I do not currently have health insurance. I was referred to Neurologist and diagnosed with drop foot and put in an AFO (device to hold foot stable) and prescribed a walker.

The numbness started traveling up my right leg and pain became more and more bothersome, so I made a trip back to ER and after a CAT SCAN it revealed a bulging disc between L4 and L5. Diagnosis Sciatica and continued Drop Foot. Followed up with Neurologist and he ordered MRI to see if Disc was herniated but my Med Pay was capped and since I do not have health insurance, could not find anyplace that would Third Party Bill so I have not went much further.

I am in the process of finding out how much tests, rehab, possible surgery, etc. would cost if these actions are deemed necessary. I DO NOT want an attorney since I believe I have a pretty solid foot to stand on (no pun intended!) but I am not sure how to haggle on these points.

Any suggestions? I do not want to sign off on further treatment unless I am compensated well just in case. Am I too optimistic to believe further treatment potential costs should solidly be considered?

Future medicals should be considered but what information do you have to show that they are needed or recommended? This is key in getting them considered. There are many ways to obtain treatment without being able to pay for the expenses. Many doctors will apply a lien and still treat. In some cases attorneys know doctors that will do this and these doctors will treat without payment up front if you use an attorney as they have "relationships" with those attorneys so they know they will get paid.

I'd certain start with finding out the other person's policy limits if possible. If they are low then there is no need for an attorney to collect the BI limits.

You will probably have a difficult time with the settlement based on the minor damage and the extent of the injuries you are claiming.
