release forms

I was in a car accident in 2014 where I was hit from behind at a red, yellow, green light. The driver that hit me was responsible. The release from I received was 3 paragraphs. The 1st stated that their insured was responsible and that by signing I discharge him, his heirs, agents, & all other companies which claim to be liable. The 2nd stated "this release expressly releases all rights of the parties released to pursue their legal remedies, if any, against the undersigned, their heirs, executors, agents, and assigns. The 3rd stated that the settlement has been read and asks for a signature and witness. When I told them they need to go to their client and get a release from him or re-write the release I was sent a new release which is 3 pgs and included my husband. He is not on the car title and my car is leased to my bssiness of which he is not involved in. What do I need to do to finalize this settlement?

When you sign the document it will be finalized. If you are not happy with the settlement, do not sign it and talk to an attorney instead.

But understand that once you get an attorney involved, you are giving up 30%-40% of the money recovered by the attorney. If the insurance company wants to give you $1000 today, you would need an attorney to get you more than $1400 to come out a few dollars ahead of $1000. You need to decide if it's worth that much trouble . . . along with perhaps having to wait three to five YEARS to get the money.
