I was in an accident caused by a Tow Truck rear ending a car and hitting me. Accident report states that accident was caused by the Tow Truck drivers failure to control speed. I believe my jeep will be totaled as there is a nasty crumple to the frame right behind the rear drivers axle. I have two questions.
1.) I know it is easier to run under my insurance, but should I run it under the at fault tow truck driver (which is more likely to give me a better offer)? Can I run it under both and choose the best ACV offer?
2.) Car is a 2009 Jeep Wrangler X. 72000 miles, Auto, Power windows and Locks, Running Boards, Tow Package. Checking KBB and NADA I am coming up at ~ 17000 but comparables in the area are ~20000 to 22000 at no-haggle type dealerships. I live in Houston Texas. Should I expect the 17000 or claser to the 20000
3.) I have no rental on my policy. Can I run my claim through my insurance and request a rental from the at fault?

1) You can ask both carriers for the ACV and then determine who you will file with. if you file with your carrier the other carrier probably will not pay for Loss of Use (rental) up front. This is because they may require a property damage release and/or because they don't have control over the time frame that your carrier takes to settle the claim. The other carrier should still consider LOU payment but just not up front.
2) No why to know what a certain carrier will pay on a vehicle.
3) Yes, subject to #1. If you file with your carrier you can see if the other carrier will pay for rental up front or as you rent, but they might not do it. Ask and see what they say.
