My grandson was in a bad car accident. The driver ran from the scene, and had no car insurance. My grandson had a broken pelvis, severe head injuries, 9 broken ribs, collapsed lung. His attorney wants to sue our insurance co. Since our grandson lives in our home. What should we do? We are both disabled, and just live off of our s.s. Will our insurance company cancelled us?

Your insurance company should provide coverage for the damage.

Really? Under what form?

This is an example of Uninsured Motorist Bodily Injury coverage. In a hit & run collision, unless the vehicle and/or driver can be identified, UMBI will not pay a claim -- the theory behind that is insurance fraud.

If the driver or vehicle WAS identified, the primary insurance on the vehicle, if any, pays first, then secondary coverage under UMBI would apply. Too many details missing here.
