STATE FARM TWO PARTY CHECKS

I was in a situation where my boyfriend was in an accident the beginning of this year. He was hit at a stop light coming of the highway from behind. So the other party was at fault. At the time, there was a lapse in insurance. I finally was able to have the chance to take the vehicle to one of there inspection site for an estimate. Being that I don't have the time because of my job to pick a shop, I wanted them to issue the draft to myself so that when I was ready. I am financing my vehicle but they want to send the check to myself with my name along with the body shop name. I need to know if I have a choice. I am not their policyholder so there is no agreement between them and my lien holder where I have quickly repair the car. But I feel like I am being pressured into something I would like to take the time figure out. I want to shop for a body shop in another county and I need time. How can i get rid of this second party being on the check?

You never mentioned if you agreed to have your vehicle repaired at one of their preferred shops. Assuming that you are not doing this, they should issue the check with only the owners name on it.

No I did not agree two have the vehicle repaired at one of their shops. So I can advise them to write the check out to my name only. I'm not sure why they are insisting to have a repair shop name on the check. I may or may not want to fix anything. I prefer to trade in the vehicle and deal with it from there.

Yes, you are correct.

Most likely they did it because the adjuster does not know any better. They are obligated to pay the owner of the vehicle. No more, no less. There is no legal requirement for them to protect the lien holder and no legal standing to not pay you directly (as long as they have not been put on notice from your lien holder).
