I was in the car with my husband and kids and was rear ended. It's my husband's car and he was driving with no insurance. Since the kids and I were passengers are we still covered by the other people?

Well it has to be first decided whether you were the party at-fault or it was the other party who were the at-fault party. It is actually the at-fault party's liability that should pay for the damages. If you don't have the insurance & the other party is the party at-fault, then I see no reason why you shouldn't get the benefit. Perhaps the senior members would be able to explain it in a better way! Thunderbolt99

As far I remember I've heard of similar cases before & it seemed to me that the State Dept. of Revenue may be a body which relates itself with the laws associated with financial responsibilities in one's state. They are the ones who are supposed to run an investigation & if required should implement the statute. So, its my personal belief that they would be the people who might help you out this time.

Hey there! See if you'd have had your UM coverage at this point it would have been a lot more easier for you guys to handle this issue. Even when the other party (if they were the party at-fault) would not have their liability in place, then also you would have secured your claim through the UM carrier. So, take this as a lesson, & its sooner you learn the better for you!

First I'm sorry but

Shame, shame shame on you all driving an uninsured vehicle and with your babies in the car! Seriously you are not only putting your selves at risk but yours and your childrens (at least financial) future at risk...You might be lucky THIS time and the accident not your fault but if you have one that is....it could ruin you financially, stealing your childrens opportunity to go to college even! Think about it please! Ok I'm done with the 'mama' thing now...

If the other party is 100% at fault and have insurance , (wouldn't that be a kick if they too are uninsured?) then yes, they will cover the damage to your vehicle and any injuries they caused in your vehicle, unless you are in a PIP state, in that case 'your' insurance would cover the injuries unless they eclipse the threshold. Unless there is a state rule or law barring an uninsured driver from collecting (which I personally think should be a law in all the states)...

So contact the other guys company make sure a claim has been reported, and go from there. The other guy or company could still report you all to the state for driving uninsured so brace yourself. I have reported some myself that were claimants, and some states REQUIRE it, if so there could be some ramifications....

Please learn from (what appears to be) this 'near miss' and protect your family.......

Did you know that your husband did not have car insurance? What state are you from? Lori is right, it could have been so much worse, what if your children were severly injured or even killed in an accident. You should always cover yourself and your children. They inadvertently become victims of our decisions, in this case, you did get lucky that they were not severly injured. I would make sure that your husband gets the proper insurance or you should not let your kids in the car, you are an adult and can make your own choices, your kids can't, so please as a mother, make the right choice for them.
