i was hit by someone with allstate insurance. my car is not drivable and I'm walkin to work in this freezing cold weather. they're givin me the run around bout liability, what can i do?

If you would tell us some of the details surrounding the accident, I'm sure that there are many forum members that would be happy to help you out. Include details like:
What kind of insurance you have yourself, and what type of coverage (be exact)
What kind of car do you own
When was the accident
Other pertinent details you can think of that might help.

Des: i was north bound makin a left, other vehicle was parked on the south bound side, vehicle sped out of the space looking back only and hit my car on the passenger's side.
Ins: I have full coverage on my vehicle but they put the claim in to the other driver's insurance company, allstate
Car: Chevy
Date: early november
allstate told me on december 16 that they would have a decision on the claim by dec. 18 and they 're still not gettin in touch with me or returning my calls.
I've heard that allstate is known for doing this so that u go thru ur own insurance and they dont have to pay...

This can't really happen, if the Allstate insured is at-fault then the other party's insurance would never pay for it.
You didn't throw any light upon the witnesses as such...as also the pics of the conditions of your car before & after the accident. Do you wish to say anything in this regard? What about the ticket for speeding ?
Listen, getting up to the DOI & complain is the lender of last resort, but before that you need to find out whether Allstate is still continuing an investigation (which might take longer if you're unable to feed them with witnesses). Now. please remember to keep us updated, Colorblind89

Who is 'they' your agent? You have the option (and should take it) of filing this claim under your collision coverage and get your vehicle repaired (less your deductible) your company will then subrogate the other carrier for both what they paid and your deductible....Were I you I would pursue this immediately rather than walking!I've heard that allstate is known for doing this so that u go thru ur own insurance and they dont have to pay...
This isn't true...there is some reason I'm guessing their insured is not responding...if so they have to send him reservations of rights letter and give him a certain amount of time to respond.....was there a police report? if so and it is in your favor and their insured in uncooperative, they can settle the claim based on this information...allstate told me on december 16 that they would have a decision on the claim by dec. 18 and they 're still not gettin in touch with me or returning my calls.
THIS IS A RIDICULOUS amount of time...and NEVER is there an excuse to not return calls...call back ask to speak to the adjusters supervisor NOW, if they aren't in ask for their supervisor and continue until you talk to someone...The only have a certain amount of time to investigate, pay, deny or request additional time to investigate a claim.......Please let us know if we can be of further assistance, and also keep us update on your progress.......

i've decided to pay my deductable and get my car fixed with my insurance. I can't take all the bs that allstate is giving me and its the most frustrating situation i've ever encountered. I do no like allstate or their actions and am filing complaint with them and my insurance company. today I flipped out and yelled at them at which point they offered to pay 50% of my damages, I spoke to a supervisor who said they'd incur 60% percent of the cost and later his supervisor told me they"d pay 70%. I'm done with allstate and their stupidity. I will pay and continue to follow up with my insurance so that they can get full payment from allstate. Thank you all for your assistance and support in said matter. And if Allstate refused to pay in the end, I will go to my local news and see if they can post a formal, public announcement accusing them. we pay so much for insurance to insure ourselves and thos around us and it seems that companies like Allstate are simply pushing us around and ignoring their responsibilities. Thank you once again...

I think you have made a good choice to use your collision coverage...appears you live in a pure comparative negligence state...and they offered that you were 30% at fault and their insured is 70% apparently your carrier doesn't agree and that is why it is going to arb...
You'll need to file the complaint with your states Dept of Ins. all have websites and all I've seen have online complaint forms...Be forwarned however, that the arb. is binding, meaning whatever the outcome of the arb. will be how this claim is settled...sorry but that's the drill...hopefully your adjuster is good at preparing and writing up arb files, because frankly this makes a ton of difference...Also (just a heads up) these take a long time (mostly) as the arb boards only meet certain times etc....
Please do keep us posted on the outcome...sorry you've had so much trouble, and this is NOT the way claims are supposed to work....as far as the not getting back to you or returning calls or making the offer a long long time ago! There are many times when people do not like or agree with the outcome, but NO excuse for it to have taken this long....
