I need help on how to go about sueing my car insurance company.. My car got flooded on august 10 when it rained really hard on this uneven street I parked it on.. I contacted the agency a couple days later when the mechanic told me it would be unrepairable. My car is a 99 maxima which is financed so It requires comprehensive... They told me that the coverage was taken off because I never took the inspection picturs and sent it to them. I argued with them for two days telling them I did . I called the place I took the pictures at, they told me they didn't keep copies for that long since I took it in october, n to tell the insurance company to contact another company that kept records of it. Three days went by, and the insurance company said they found them and I had to pay 600 to put the coverage on before I can place a claim.. I'm a full time student at a community college n have to pay for school myself so 600 would take a little while to come up with since school was staring the next week. Two weeks went by and I got the money and wrote them a check. After placing the claim and getting it apraised the came up with a stupid idea to give me 1600 for the car when my is worth 4500 beacause of highway miles. They told me they wouldn't pay for the storage fees for the whole month it was at the garage and that the car had $2100 worth of damage which the deducted from the true value. My car was perfectly fine before the flood there was no damage and now they tell me they won't pay the storage fees because I never contacted them when it all happened... Now I don't kno what to do... If someone had done their job at their end my coverage would have still been on and everything would have been taken care of... So my question is how do I go about resolving this problem because I don't want to get a lawyer because that will take longer and will leave me with almost no money after I pay them...sumone please help me

What? where did you ever get the idea that highway miles change a value of a vehicle? If you want to provide all the information, yr/make/model/mileage all options i'll run a value for you...but high miles lower a vehicles value..period...if 'highway' miles were different wouldn't every one with a high mileage car claim 'highway' miles...?that the car had $2100 worth of damage which the deducted from the true value. They would've had to write an estimate for this prior unrepaired damage...are you saying they made all of this up? there was not one bit of damage AT ALL on your car prior to the flood? Two cars exactly the same, one has a bashed in fender and torn up seats...other does not...which is worth more? Of course the undamaged vehicle...If someone had done their job at their end my coverage would have still been on and everything would have been taken care of
I agree with you to a point..you also got your policy in the mail and would've shown NO comprehensive coverage on your car...didn't you wonder why your premiums were so low? The policy states it is your responsiblity to make sure the coverages are correct...so that's how they hung you...when you sent the requested photos and your premium did not increase didn't that throw up a red flag to you?I don't want to get a lawyer because that will take longer and will leave me with almost no money after I pay them...sumone please help me
I doubt an attorney would help in this case to be frank...try filing a complaint with your states dept of insurance...regarding the whole photo thing...to start...as far as the storage etc...if you ask the lot they may waive it if you sign over the title...don't do that until you settle as owner retain with your carrier...but do call them and see if that is an option...first you need to do that, then figure out your vehicles true Actual Cash Value...Add your comment
