My car was recently involved in a hit and run. There was a witness who gave me the license plate of the other vehicle. I called the police and then turned all the information into my insurance company. I got an estimate as requested by my company, when I took the estimate in I told them I didn't think I was going to get it fixed since my car is paid off and I am looking to get a new car within the the next 6 months. The damage was about 1800.00 but the car is drivable and is only a little cosmetic damage. My insurance company told me I didn't have a choice, I have to get it fixed or they will not pay a dime. Can they do this? :(

Nope. If you want, speak to the person who told you this information and ask them where in the policy they issued does it state that the amount is not owed unless you have the vehicle repaired. You can certainly show them where is states when you have a loss they will issue payment less your deductible. When they get tired of looking, let them know you will expect the payment shortly.
If this does not work, simply ask to speak to a supervisor. I can hardly believe that any adjuster would say something like that. It's about as stupid as it can get.
Bottom line, the policy requires them to issue payment and does not state anything needs to be repaired and on top of that, the payment is to compensate you for your _loss_. If you don't have the car repaired, you still suffered a _loss_.
Right now, they are acting in Bad Faith (if you need to, mention this).

NO THEY CANNOT! Who told you this an 'agent' or 'adjuster' ? I'm betting on an agent....follow tcope's advise, and if it was the agent, tell him to report the claim to his/her claims dept.Add your comment
