Totaled Loss of Car

I was in a car accident a while back in my 2000 Plymouth Breeze. The car was towed and later the insurance company said it was totaled. I didnt let them total the car and went to pick the car up. Later, i received a check and used the money to get the car fixed. My friend was just in a accident Dec 31, 2008 in my car. It was established by the police and the other driver that it wasnt his fault. The insurance company has claimed that the car is absolutely totaled this time. I was wondering will i receive any money for the car to help get another car even though the insurance company claimed it a total loss the first time?

Depends on if the know the vehicle was a prior total loss and if they feel that because it was, it's worth less.

Many insurance companies report (as required) to the state that a vehicle as handled as a total loss. This allows the state to change the title to a salvage title. If you have not heard anything for the past 8 years, then I doubt this was done. Insurance companies also report many property damage claims to an indexing system. If the insurance company uses a vendor such as CCC or AutoSource is they will see that a prior carrier recorded the vehicle as a total loss. This is only true _if_ the prior insurance company reports such things. It's very doubtful that the reported the vehicle as a total loss in either way.

I don't see any reason why you should be treated differently than the other party. Both of you seem so much careless and it seems quite irresponsible on your part when I think of the cost in terms of human life or bodily injuries.
The only way you could avoid any financial damage is by proving the other party to be at fault. But that's just not sufficient enough to save your face!

Yes, you will. A car being salvage titled only means that you cannot carry collision coverage on it. It does not shield another insurance company from paying out damages to you if their driver was at fault.

It's very doubtful that the reported the vehicle as a total loss in either way.



This is irrelevant if he is not at fault. If you were at fault and the vehicle was previously totaled then you would not be entitled to damages.
