How to sue insurance company for fraud

Back in june of 08 I wanted to renew my Workmans Comp Insurance But I needed it changed. I needed to change the coverage from carpentry and siding of two story dwellings to satellite tv installations also I needed to have myself covered under this policy which I didn't before. So I went to my agent to have this done I got my quote for the policy which was about $2,500 which I thought was alot but I never had to cover myself on the policy so I figured it could be that much so I paid the $2,500 in full like your suppose to then in november of 08 I get a bill for $1,250 on top of the $2,500 I already paid when I called my agent she said she didn't know why I was getting another bill but it says I owe it so I need to pay it after a month of phone tag I still had no idea why I owed more money finaly I talked to another agent at the same company who figured out that they raised my premium based on last years audit thats when I said wait a minute whats the policy covering and the first agent never changed the policy from carpentry to the tv Installations so they end up canceling my policy because I said I wasn't paying more money on a policy that isnt what I needed in the first place then they said I couldn't get the right policy until I payed the $1,250 on the last policy so now im into a policy that I don't have for almost $4,000 that wasn't what I wanted in the first place and I can't get a new one because all my money is tied up in a policy that they had cancelled and not having this Insurance could cost me my job Ive absolutly had it with them and its starting to cause problems at home :x :x :x

I recently requested a copy of my life insurance policy since I have moved and their are other options with the new employer. When I received it today I was shocked, disgusted, and very upset at what I saw. It had a normal cover letter addressed to me stating it was sending a copy of policy per my request. This was signed by an employee working there. The next page was a letter again addressed to me with account number etc, however it was signed by the President and CEO of the insurance company. This letter was a typical letter thanking me for utilizing their insurance, and a paragraph about their reliability. It stated how they "enclosed two copies of my life insurance summary and to sign and return one copy and keep the other for my records. The final paragraph states "Be assured that (Name of company) is committed to protecting your privacy, and we will treat your personal information with complete confidentiality. Enclosed is our company statement regarding our privacy commitment."

Well, the part that has me peeved, shocked, and extremely upset is the next several pages. They sent me another person's information including their SS# all over the pages, address, phone, and anything you would like to know regarding their work, family, age, and yes their health information such as smoker, disabled, Aids or HIV, long term accidents or sickness, heart disease, blood pressure, cancer, stroke, diabetes, etc...The next pages tell me their annual salary, date of hires, birth date, ss#, and more.

Thank goodness I am a decent person and put it back in the envelope and will not review this person's information including birthdate and ss#. However, I am extremely upset at the negligence, because that means my information is in the hands of someone else as well.

Can you please tell me if there is anyway I can sue this company for this negligent action and in turn my information is out there including past health issues, my children's names and birthdates, my financial information such as employer and annual salary, and of course all my contact information including SS# and birthdate? I am beyond peeved and feel very violated! Thank you for your answer and guidance.

Thanks guys for yours nice posts. It is very useful information as depending on how right you sue you will be able succeed in a case. There are a lot of scam concerning auto insurance. Just check here http://www.pissedconsumer.com/consumer-reviews/insurance.html. The issue is very actual.

What are your damages? You are concerned that your personal information has been improperly released, but you have no proof of that, do you? You cannot sue because you "think" something might possibly have been done with your ID. You have to be able to prove your loss.
