I have a question - HELP PLEASE

by redsoxrc » Sat Feb 14, 2009 08:08 pm

I have a question. Lets say my son is driving around, and has had his license for 3 months. He is driving with his 3 teenage friends, whos parents know that they are with the driver but don't mind. If the driver were to get in a wreck, who his parents be liable or would the insurance company be liable and to what extent?

pretty much what i am asking is if insurance companies cover your accidents when you break a secondary offense.

First, is it a law in your state that a person has to have their license longer then 6 months before they can have more then 1 person in the vehicle? If, so, are YOU giving him access to the vehicle? I'm not clear on this. It seems like you might be mentioning that some other parent is allowing him to use their vehicle.

If you would elaborate on who is allowing him access to the vehicle, that would help.

But ultimately the driver _is_ going to be held liable for his actions. So _your_ insurance is certainly going to be involved. However, the vehicle is listed on someone else's policy so chance are that the owners insurance is going to primary. Most likely your insurance would be excess over the owners insurance.

However, if driving with more then one person is against the law for people who have had their license less then 6 months and your son is pulled over, he _will- have his license suspended for quite some time. He's 16 and does not know better. However, you should. You own your child. His drivers license can be taken away just as easily as you let him get it.
