I was in a rear ended last year...I have a had back surgery..the at fault party has limits of 100/300. My medical bills are approx 115,000. So does my underinsured policty come in and pick up the rest and if so, will my insurance have to pay some toward the settlement amount?

Yes, you UIMBI coverage would address your remaining medical bills and your "pain and suffering". You need to notify your carrier at this time if they don't know about the accident. Also, your carrier needs to be notified once the other carrier offers their policy limit and before you accept that policy limit.

If you have private health care they will come in and help pay also but may subrogate later to be reimbursed for what they paid towards your care. Hope you are on your way to feeling better.

I am in the process of waiting to get all my medical bills in. My attorney tells me there is a 60 day period that they have to receive bills. There are only a few bills not in (which dollar amount is rather small) Can I tell my attorney I want to proceed without those bills in. I have been with paycheck for several months and am sinking fast......any advice

Your coverage should pay for the rest of the damages by what you have addressed here in the forum. I would think that your coverage would pick up the entire amount plus more if needed. Call your agent and get an attorney if need be.
