I was involved in a accident in April. The person who hit me left the scene I followed him and was able to stop him after several blocks. He received 2 tickets. The driver is not the policy holder but he is contesting the tickets. The policy holder was a passenger but his isurance will not pay out until they find out if the tickets will be dismissed. Should I contact a attorney

What is an attorney going to do? Liability must still be a fact in the accident if the carrier is waiting to see if the citations are dismissed. You don't mention how the accident happened.
If the dismissal of the citations might indicate that the person was not guilty of the infraction and if the infraction itself is what liability is based upon, then the carrier might want to wait until they see what a judge states. There is really not much that can be done in the meantime. You can file an complaint with your states Dept Of Ins if you wish. You can also file a collision claim under your own policy if you have collision.

I've had a few claims over the years where we waiting on the outcome of the citation to proceed with the liability determination...They aren't doing anything really 'wrong' by holding off...most likely it's a stab in the dark anyway they are hoping their driver will get off...but just because he does get the tickets thrown out (if he does) does not automatically mean there was no negligence on his part..
We'd need to know the specifics of the accident facts to help you further, provide those if you'd like more help..sounds like minimally he got a ticket for leaving the scene of an accident maybe?
