Medical settlement offer too low?

Hi!
I was rearended by a guy going about 25 mph as he entered the parking lot. His hitting me forced me headon into another truck. My car was totalled. Thankfully, the auto claim was all taken care of by my insurance, and I had gap to pick up the rest. The guy who hit me has only 5k for collision, and 15k per person for injury.

I sprained my neck, arm, wrist, and ankle, and was in a great deal of pain for about 2 months. I went to acupuncture 2x a week until recently, and it helped me survive my daily life. I work from home, so I didn't lose pay because of this.

The adjustor just sent me an offer of 2600.00, which I have to use to pay for the acupuncture bill. I want to know what you think is reasonable/fair? I want something for my pain/suffering. I barely got through these past few months, took way too many advil, and gained 7 pounds since I had to stop my excercise routine. I also had to cancel a family trip which would have involved a long drive. My arms hurt too much to do the drive, so I ended up cancelling.

Long story short, I feel I should get the following: 1500 acupunture bill paid, 3 months of future treatment which comes to about 2000, and another 3000 for my pain. Total: 6500.

What are your thoughts? Is this a good counter offer?

It depends upon review of your injury, as well as the incident. Was your car totalled? What was the value of your car, what was the damage to your car and other persons car? Nothing is mentioned

my car was totalled. My insurance paid 12,500, and gap paid 3600. Major front and rear damage. I was looked at by my doctor, she noted swelling in wrist/ankle, and said I sprained them. She said my neck/shoulder was a bad whiplash. While I was there, my heart was in tachycardia,and they put me on EKG to observe me for a while. I wasn't admitted, but she said I was in shock from the accident.

I is a personal choice on what you feel is fair. I don't see the company paying for future treatment for acupuncture treatment. If you are not 100% then don't settle, acupuncture treatment is not looked at as "real" treatment (right or wrong) by a lot of insurance companies. If you are looking to settle now, I would guess they may be willing to go to $3,500. tops. May be you could squeeze 4K which would include your medical bills.

I missed your question. $6,500. would be a good counter offer, as long as you know that they will most likely not go for it but should come back with something higher. If they come back with 3K, you'll know that they are at about their high end of about 3,500. Approach them on a personal level about missing the trip.

Remember, once you sign the documents, you cease all your future rights. Please take your time, think what is good, then decide.

Note: I am not a insurance expert, please take a prof advice

Hello Barbara, I too feel that for a PD claim worth of $12. 5 k, the amount seems little too low for BI settlement. Please pay heed to the advice of the adjusters on board and make a counter offer to the insurance company.

Have you received only acupuncture as treatment for the injuries? Have you been recommended to the therapist by your doctor? Wasn't there any conventional cure for your injuries?

Did the doctor certify that you'd need treatment for another 3 months?

Also, why do you think you should be reimbursed with $3,000 for your pains? Is there any specific reason for it?

Why do you think she wants pain in suffering do you think she asked to get struck by another car???????? Do you pay for insurance??? You might need it someday yourself dumbass..
