I was at a red light when I got rear ended. The person who hit me admitted that he was at fault and pictures show his damage and mine. No police report was filed since I was driving without a license and that would mean my car is impounded and ticket given and possibly not be able to apply for a license for quite a while. I know not having a police report is going to be a problem, but the consequences of police on the scene seemed higher than benefits of the report.
So, is the other guys insurance company still liable to pay for my damage?!?! It was a major crash and my car is pretty messed up.My kbb value on the car is $5,000 if that helps with an idea of how willing his company is to pay up.
If they do deny me for not being licensed, can i still pursue him in civil court? What are my chances there. I have pictures of the damages to both vehicles if that helps in court.
I know I was stupid not to drive without a license, but its kind of a long story on why i didn't apply for one.But i still feel that the guy has no right to rear end me no matter what,. just need some advice on the situation. state is california if that helps.

The fact that you did not have a license does not play any factor in determining liability. The guy rear ended you plain and simple. Even without the police report, the damage to both vehicles should tell the story. The only problem that could arise regarding your claim is if the other driver decided to deny being in an accident, and as there is no police report there is no official record of the accident. It’s not likely, but I have had it happen where someone will get their vehicle quickly fixed or the vehicle disappears and then deny being involved in an accident.
When your vehicle is fixed....drive it down and get your license.
