Just ask the Insurance Company for a copy. It is your right to be informed of everything their doing, pertaining to this investigation.

Hey Sdchargersfan, I'd love to know if they'd offer a detailed report or just a summary of things. I would often wonder if it was at all possible to achieve investigation reports through the different phases. Do keep me informed!

You can always ask, but the insurance company does not have any obligation to release information obtained. They do have an obligation to keep you informed on your claim usually every 30 days.

Well,.....in my opionion, I think ANY Insurance Co, you are dealing with (claim wise) should give you a copy of the information. Actually........with 'MY' Insurance Co, they gave me a detailed report of investigations, etc. That way, if I had ANY questions right then, I could ask about them.

"should" and ''will'' are two different things. I would be VERY surprised if they gave you a copy of the recorded statements of the people they interview. They most definately ARE required to keep you updated and let you know how they reach their decision, but in no way are they required to give you any copy of anything that is not public record that exsists in their claim file.Actually........with 'MY' Insurance Co, they gave me a detailed report of investigations, etc
So that would've been a summary of what had happened not an actual copy of anything like a statement...But you most certainly could ask...

REALLY?? I thought Insurance Co's gave you a COPY of the original reports/claims. The ORIGINAL one would be 'on record',..so, why not give you a copy of it? Hope my question/concern is clear.

Anything in a claim file is work product and protected as such and only with a court action may be released....even then they will try to fight it if they want to keep something confidential. This is why some companies don't want informal e-mails from adjusters since they could be discovered down the road in court.
Nothing on file is on record or filed anywhere but in the insurance company's drawer. They will supply estimates (dwelling, auto) to the insured or claimant and in some (all?) states have to supply a copy of a written/recorded (transcribed) statement to the individual that gave the statement but not to third parties that did not give the statement.

Hi, you've said that your carrier is still investigating things. I guess it would be wiser for them to keep things and analyze the possibilities till they arrive at a conclusion.
They might convey their explanation as and when they'd be ready to settle things with you.

Why would 'they' do this? I mean, something like this could 'make you' or break you', reguarding the accident..ya know?Posted: Tue Aug 18, 2009 12:40 pm Post Subject:

There are very very very strict laws regarding privacy. For instance, there is no need for an insured or claimant to know the others address, phone number etc. I don't know what you mean by make or break you...the adjuster is the one determining the liability they are the ones that need all the info.Pagination
