i have been out of work 2 years. I have 30,000 in medical bills. Unemployed because i really dont know how to do anything else besides being a laborer. In school currently to learn something else. I am still in pain have a slight dislocation in my neck, and herniated disk. my lawyer suggest a demand for 85,000. I think thats too low considering the amount of pain i am still in, and not being able to get a job due to my physical condition. Is 85,000 a fair demand.

Only you (and your lawyer) can answer that..we can't intelligently answer that question without knowing all of your medical history (past and present) the entire facts of loss, area of the country...I could go on and on...You're paying this guy/gal (attorney) at least one third of YOUR money...Seems to me if I was coughing up 25-35k to someone for a couple of days work (at best) I'd have a lot of confidence in that person. :wink:Posted: Fri Aug 14, 2009 05:00 am Post Subject:
Just like you should question an insurance company how they arrived at a figure for say a totaled car, you should question your attorney how they arrived at the 85K figure. I agree with Lori for the most part. I would say only you can determine what you think is fair. Your attorney is there to "guide" you through the process and go the distance if needed, but should not pressure you to settle for an amount that you do not think is fair.
I am not saying that the following is what your attorney is doing, but many attornys that I have dealth with like to "turn'em and burn'em". The more claims they get settled without putting in much time (and no court time), the more money they make. If an attorney and I were close on a settlement, they would want to discuss my bottom line and would state that they would get their client to take it. Was it fair to their client, NO....but it would get claims closed within my authority. How they worked it out with their client was on them.
A couple things you need to find out are how the medical bills are being handled. Who is paying them now? Your health insurance? Will they want their money back? Will 30K need to come out of the 85K as well as your attorney's 33%.
