Shopping Cart Hit My Parked Car

A shopping cart hit my parked car and the adjuster would like to know if I was in the vehicle at the time of the accident... should I admit I was in the car or not? Is it to my advantage that I was sitting in the parked car during the accident?

Can a shopping cart cause "whiplash". Then I was in the car also and my chiropractor said I need a lot of treatment.

I understand what your saying but there are two things I have to comment on.

Personally I never liked the phrase "act of god". It makes it sound like some deity is to blame. Stores usually provide corals for carts in the parking lot and usually send someone out on a regular basis to collect the carts. That is, they make a reasonable attempt to provide a safe area. Is there any other reasonable thing they can do? Nothing is going to eliminate this from happening, they don't need to guarantee that carts won't damage vehicle. This is where the "reasonable" part comes in.

The other thing is "get of out paying". Perhaps just a choice of words but lets say you own a business and you spend a great deal of money to make sure it's safe. At some point someone is going to get hurt on your property. should you automatically have to pay this person money? I don't see it as "getting out of paying"... I see it as being liable or not.

get out of paying for the damage



This is filed under the same statement that they denied my coverage due to some SMALL PRINT in the contract. Every policy I've ever read has the same size print, except for maybe the headings which may be bigger and in bold print.

Or "loop holes". You know those pesky exclusions in the policy.

Some yrs back my car was hit by a shopping cart. It caused a good noticeable dent. I didnt know i could do anything about. I still have the dent to this day. It would cost $100.00 to repair. Repair shops sure arent cheap especially in ca.
