If a 16 year old "excluded" driver is driving her parents' vehicle and is involved in an accident with my vehcile (did not yield right of way and ran out in front of me), she is found at fault, their insurance denies my claim based on the exclusion, are the parents then financially responsible for my car damages (which was totaled) and me and my son's injuries???? Also, can the police then go back and ticket the 16 year old for no insurance after the fact?

Yes they would be responsible.
Why would you want this kid to get an additional ticket...how does that help you?

This "kid" got behind the wheel of a moving vehicle and cause an accident. My 10 year old sustained a neck injury and I have neck and shoulder injuries. Have you watch a 10 year old being taken out of your car on a stretcher with neck brace, etc???? This 16 year old "kid" needs to learn responsibility. She could have caused a death. Now, due to her irresponsibility and the negligence of the parents, I'm having to seek further medical attention, miss work, looking at surgery, having to pay deductibles and copays...being a single mom does not allow me the luxury of liquidated funds to cover someone else's mistakes. Perhaps a no insurance ticket might give that "kid" a wake up call. Please don't take my response the wrong way, the past two weeks have been a total nightmare...as well as my 10 year old unwilling to get back into a car yet.

My DH is a Deputy so I asked him. He said depends on state rules but here they can ticket after the accident and after the party was sent on their way. He said usually they dont but they can

My point was, the accident was going to happen whether the kid had insurance or not. You and your child were going to have the pain whether the kid had insurance or not. The kid and their parents are going to pay one way or the other. I understand the point of wanting revenge and making a point to the kid...I just don't see the point at this time. Coming from someone who was irresponsible behind the wheel as a kid, I would hope this kid learned a lesson from the accident itself. And the parents are going to learn a lesson when they have to pay out of their own pocket or out of their assets for your loss.

Parents are definitely responsible for your car's damage as well as your injuries,may be you are also somewhat responsible for this for letting her drive the vehicle (if you are knowing about who is going to drive).
Her parents should pay the money towards your hospitalisation.

Absolutely! Your carrier will take care of your vehicle under your collision coverage, they will also handle yours and your son's injuries under your Uninsured Motorist (BI) coverage, (which I'm assuming you have). Then your carrier will go after Mom and DAd of the brat, to make them reimburse your carrier for all payments including your deductible...Also, can the police then go back and ticket the 16 year old for no insurance after the fact?
In my area this happens quite a bit, (tickets issued after the fact)...You might want to call the police and let them know, see what they have to say....(personally I 'get' it...re: why you want her to 'pay' all she can)...Add your comment
