On August 19th 2009 I Was On My Way To Work.I Have To Get Off Of Camp Creek Pkwy And Get Onto Main Street To Get To Work.This Particular Morning There Is A Car In Front Of Me Getting Off Of Camp Creek.Once You Get Off Of Camp Creek You Can Either Go Straight Or You Can Veer Off Into The Right Lane Going Towards Main Street.We Both Got Off Of Camp Creek.The Lady In Front Of Me Continues To Go Straight Ahead While I Am Veering Off To The Right.As I Am Going To The Right The Lady In Front Of Me Going Straight Comes Over Into My Lane And Side Swipes Me.We Get Out And She Ask Me If I Am Ok And I Do The Same.We End Up Parking At An Enterprise Place.I Call The Police Which Came Out 15 Minutes Later.He Gets Her Side Of The Story And I Tell Him My Side.She Got The Citation For Failure To Maintain Lane.I Missed Several Days Of Work Because Of This. I Am Seeing A Chiropracter As Well.My Attorney Calls Me And Lets Me Know That Earlier Today She Got A Call From The Ladys Insurance Company Saying That They Are Denying My Claim Due To There Investigation That They Found Me Trying To Go Around Her.Number 1 I Did Not Try To Go Around This Lady And Two Any One Can See That It Is Not Possible To Go Around Someone When You Are Going To The Right It Is Only 1 Lane.I Need Advice.I Am Willing To File Suit Because I Was Not Wrong.My Question Is Once They Know That I Am Filing Suit Will They Be Willing To Go To Court Or Will They Settle.I Always Hear That Insurance Companies Dont Want To Go To Court.Please Note I Dont Have A Problem With Going To Court Because I Was Not Wrong.She Got The Citation Please Am Pm Family Give Me Some Advice.It Is Greatly Appreciated.

I got to ask...why are you not asking your attorney that you are willfully giving ALOT of money to, this/these questions?I Always Hear That Insurance Companies Dont Want To Go To Court
You've heard wrong..Ins. carriers have their own attorneys that get paid whether they are doing anything or not..if they feel they have a case that they can win, they will fight it, if it makes sense. Your claim is likely a small one (chiro)..so they may settle, but (again) your attorney is taking atleast a third of this....Please Note I Dont Have A Problem With Going To Court Because I Was Not Wrong.She Got The Citation
Just because she received a ticket doesn't automatically place her at fault...A lot of people have this misconception. She could just as easily had it dismissed...Please Am Pm Family Give Me Some Advice.It Is Greatly Appreciated.
Honey, you need to ask your attorney what he thinks you should do...The carrier should already know you are atty rep'd. Your atty should've already sent a rep. letter to them...One more question...why do you cap every word? Makes it hard to read..

the person that received the citation did not pay her ticket and on the day she had to go to court she failed to appear in court.any advice someone.she is guilty,she hit me she got the citation and she failed to appear in court,can someone tell me what they think will happen

Again, her citation will have little to no baring on the ins companys decision.
