the car is in my dads name an my dads insurance, he did not tell us we could take the car, an my friend was driving...she has insurance on her car.

I could see some possibilities..but there are somethings that I'd like to know first. Were you listed in his policy? Do you share the same household as that of your Dad?
Otherwise you may even have to settle a case outside the court (with your Dad). For the rest of it, I could see her share of irresponsibility coming in between and her insurance carrier shouldering some of it.

Insurance stays with the car and is always primary. The only way your irresponsible friend's insurance will even enter the picture is if Dad's limits are too low...or the damage she caused is over Dad's limits...

Poor dad, now HE not you and friend will suffer a rate increase, or non-renewal for this terrible thing you did to your father.

Same question... should be a different thread though.


Your friend would be considered an insured under your policy so your fathers policy would provider her liability insurance to address the damage that she caused to other people's property (not the car she was driving). If you were to pursue her directly for the damage your fathers vehicle you'd need to do that directly by either asking her to pay or filing suit against her.

One of the first things that most car insurance agents learn is the idea of "insurance follows the vehicle, not the driver."

This means that if there's any insurance on the car that considers the driver an "insured," (and it sounds like your friend is considered an insured on your policy under this idea called "permissive use"), the policy on the car would provide the primary insurance coverage. So, your friend's insurance normally comes into play only if your insurance doesn't have high enough limits to cover the damages (injuries or property damage). The idea of "permissive use" is that if you lend your vehicle to a person with a valid license and your permission to drive the car, that person is covered as you are covered. It was mentioned earlier that your insurer would go after your friend's insurance, but that's not likely here. The most likely result (if the accident was your friend's fault) is going to be a rate increase for you. That doesn't always happen; it depends on any number of things, but it easily could. Talk to your agent about that.

You have the right to go after your friend in civil court to recover the deductible and increase in premiums, but is that a good idea? Good friends are hard to come by, I think it would be best to have a talk with your friend and ask them to pay any costs associated with the accident.

Ok...please tell me this. Why are you taking ANYTHING, of you dads, without permission? Why was your friend driving and not you?..................lots of questions, I suppose, I have.
