Who ever was at fault in the accident.

I don't know what state oyu live in, OP..but, in PA, you can get some MAJOR fines for driving without a valid DL and Insurance. I've seen people get their DL revoked because of it.

They revoke a person's drivers license if they don't have a valid one?

Sorry...guess I wasn't 'clear'. I meant when it came time to 'renew' a DL ( in PA, it's every 4 years, I think), the person can be told they can no longer "obtain a DL." Providing, they din't have a vaild DL and no Insurance when getting into an accident. It would be like a 'double whamy' on your driving record. I actually know someone going through this right now.

I agree that it IS whoever was at fault in the accident...dealing with the person driving without a license or insurance would be secondary.

I'm very curious about something (if anyone happens to know)....are there ANY states that have a law that if a driver does NOT have a valid DL/Insurance, an accident would AUTOMATICALLY be their fault?
