Can i let my x wife drive my car and make the payments and I not be held liable. she can't get financed in her name because of her credit

Most likely not... and this is a BAD idea! Most states will allow the owner of the vehicle to be held liable for an accident that the driver causes. Also, unless you want to make the payments on the insurance, I'd not trust that she was going to maintain an insurance policy with your name on it. She could miss a payment and continue to drive with no insurance and you could be on the hook then as well.

Trust me... this would be a bad idea.

If you say that you're the owner of a car then the responsibility of any mishap arising out of it would be yours. Thats it!

Yes, then under any accident she could be considered as an 'uninsured' driver & I guess you won't be spared for whatever she comes up with.

PLEASE....read some posts on this site....and you will see just how bad of an idea this is.....if you must, then YOU make the insurance and car payments (let her pay you back) atleast that way you will have some peace of mind knowing that you are protected should she just not make the payments or not have the money to do so....

Actually there might be one way. If she can get a loan with you as a co-signer then at least here in ohio she could title it in her name only and get her own insurance. I don't think I've ever heard of a co-signer being held liable.

You would be financially liable for her car payments though, and unless you really trust her pay you, that could get ugly too.

But as far as legal liability it think you'd be safe.

Lori/Tcope tell me if I'm wrong. Ever seen a non-title holder held liable just because they cosigned a loan?

no, I haven't as long as they are not a legal owner...(which is precisely why our names were not on our kids titles :wink: )...other than of course as you mentioned financially with the bank...only thing might be is in that case if she defaulted he took over the loan, wouldn't he then be the owner? or not? would she stay the owner even if she defaulted on the note and he had to assume it? I don't know the answer to that one.... :? course one would assume if that happened you would also take the car back!

Back to the ex!!!!!!!!! LOL My ex had a good, used car BOUGHT for him ( yep..Mommy and Daddy bought it!!) However...........his parents told him he had to get his OWN insurance. My ex was in an accident ( YEARS ago). It involved a fatality. THIS is still on my ex's driving record. My ex asked if I would get insurance in MY name, and he would pay me back each month............OHHH PLEASE!!! I don't think so!! And ruin MY driving record, too??!! NOPE!! Anyway.that's my story I'd thought I'd share. :shock: :shock:
