I am going to be laid off because I am too sick to work but do not yet have a diagnosis although this has been going on for months. My boss has been very patient but I have been out of work too much. I am seeing doctors hoping to find out what it is. My question is; can I first apply for unemployment and when they find a diagnosis then apply for TDI? I live and work in Rhode Island.

If laid off, when you apply for unemployment insurance benefits, you must certify that you are capable of working and actively seeking employment. If you cannot honestly make that statement, a misrepresentation is a crime for which you can be sent to jail. So you probably just need to apply for disability benefits instead. If your illness could possibly be work-related, you should file a workers' compensation claim ASAP.

I am having carpal tunnel surgery in Feb. Now I recieve lay off notice due to budget cuts. Can I recieve disability for the 6 weeks then apply for unemployment when I recover and look for work?

I was laid off in September 2012 while on personal disability leave. My SDI has now run out. Do I base the answers on my UI app on my last paycheck, or my SDI benefits?

SDI benefits are not qualifying wages for unemployment insurance benefits. You did not pay any income tax on that money, which is a clue.

Hello, I have been out of work for 14 months for surgery. I am being told that my LTD have been exhausted does this mean my unemploymnet benefits are exhausted as well? If I could get my physician to signa a return to work note, could I start unemployment?

Disability and unemployment are completely different issues. Check with your unemployment assistance dept.

How long have you been working before this 14 months?
Were you receiving any benefits?
Are you talking about disability insurance or disability benefits?
Was there any break of service?
Lastly, if you get back to work and the physician permits, how could you expect unemployment benefits to continue?

i have been on disability for 9 months, was then laid off. Can I now collect unemployment ? Would having not worked for 9 months affect how unemployment would be paid ?
