Do I have to accept aftermarket and used parts?

I recently got into a car wreck. Not my fault and Farmers is taking full responsibility. They are trying to use aftermarket parts and telling me that I have no choice in the matter. My body shop says I don't have to accept them. Who is right? Do I have to accept aftermarket and used parts?

Both... Farmer can consider the price of AM or used parts and you can put any part you want onto the vehicle. You would just need to pay the difference for the brand new OEM part in place of the used part that was on your vehicle.

But Farmers isn't giving me that option. THey are basically saying take it or leave it. Why should I be ok with products that lower my resale value?

You don't have to accept it. However, you always have the option to pay the difference. It is your car, you authorize the repairs.

You can file a diminished value claim as your vehicle's resale value is infact lower. What kind of vehicle is this?

Best advice I give anyone is to pressure them into asking why they will only pay for aftermarket or used parts. Saying thats all they are obligated to pay for is not real answer, however most vehicle owners accept it and move on. The majority of auto insurance polices are based on acv (actual cash value) and not replacement value (parts prices). If you have a thorougly prepared dv claim, I have see many insurers change their tune and pay for oem parts when a tru dv claim is presented.

The insurance company is not the one's repairing your vehicle. They are _only_ issuing the payment for repairs (your loss). You can take that repair money and do anything you want with it. Buy bread, buy a new car, pay for any repairs you want to your vehicle.

Certain states have statutes that will not allow an insurer to use aftermarket parts if the insured refuses to allow their use. It completely depends on the state. As well, most states have laws dealing with diminished value issues after an accident that exceed a certain dollar value.

Correct. I can remember when working in a shop under a DRP contract, that carrier would allow us to repair with all OEM if the owner threatened a dv claim all in order so the owner would drop the claim. Some major carriers will bend if the claimant demands all new parts. Many insurers are dropping all aftermarket sheet metal endorsement and others will follow. Liability is becoming too high.

apology for making this thread up if i were you i didn't accept the aftermarket car parts. you have a choice. don't let them give you that parts. :twisted:
