I recently got into a car wreck. Not my fault and Farmers is taking full responsibility. They are trying to use aftermarket parts and telling me that I have no choice in the matter. My body shop says I don't have to accept them. Who is right? Do I have to accept aftermarket and used parts?

I live in Kentucky and was in an accident not my fault. The other persons insurance said they revised the estimate I sent. They based it on after market parts. Do I have to accpet it???

I guess it's better if we can pay the difference when we want new parts to be placed. We can always have a word with them regarding this.

When you go to the drugstore to get a Rx and the name brand medicine costs 125.00 under your health insurance and the generic cost is 7.00 you go with the generic, the insurance company will make sure all aftermarket parts fit and or preform as the OEM part will, people are willing to put aftermarket medicine in their bodies but not on their vehicles

There are a few things you have left out in your question, are you filing though your policy or the other parties. ( the at fault person ) if you are filing though your own policy you need to read your contract and I am sure there is a statement in there that allows them to use after market parts if you are filing through the AT fault parties carrier depending on the State the loss occurs in you can actually demand factory parts and diminished value here in FL if you are the claimant you can do this and we are required to do so by FL statue
