Hit Head-on and lots of questions...

by camper650 » Wed Jan 28, 2009 01:01 pm

My wife and I were hit head-on by a driver that just wasn't paying attention. It's been nearly 3 weeks and the insured's adjuster has been in touch with me twice, and he still hasn't looked at our totaled vehicle. Is this normal? Any accident I have ever been in, it normally gets done pretty quick.

Another question, I've been off work for 3 weeks and my lost wages are measurable, but my wife doesn't work (only at home.. homemaker, 2 children) and her injuries were probably worse than mine. She was hammered by a first generation air bag. Severe contusion to the chest, but no broken ribs, just soft tissue damage. Since she doesn't have lost wages, how do you estimate or calculate any type of settlement when the time comes?

Will have more questions later, I'm sure!!
Thanks,

I left out the key to it all... "It was only driven to church on Sundays by my "little ol' lady!!"

tell the adjuster that he'll get a kick out of it..

If she reads this.... It may be my last post!!

certainly while setting anyway

SD, I'll send a note and see if I can find out what the reason was...sorry honey..

Adjuster finally got back with me today.... Imagine my surprise when she came up with a figure of $3710!! And that was using CCCP. I then explained the work I had done to it and the receipts I had. She seemed very excited and asked how quick I could get copies of all the receipts to her. I told her I could scan them and e-mail them to her. She commented it should make "quite a difference" and that I would have a new figure before the end of the day.

Well, I missed her call this evening, but she said I will be hearing from her in the morning.

Anxiously awaiting....

That's great camper! 3700 is about what we'd come up with...so hopefully you'll get another 500 or so...be sure and let us know....atleast you know you are at a good 'starting' point!

Well, the call came in this morning, $4300. 8) I really can't complain about that, as a matter of fact, quite pleased!!

The adjuster also commented how pleasent it had been dealing with me  and asked if I had replaced the vehicle yet. I told her I had not, so she recommended I go ahead and keep the rental for "another week or so" while I shop for a replacement vehicle! Couldn't imagine even asking for that!

I'd like to thank you all, especially you Lori, for your support and advise. But this is just one peice of my claim... so when it comes time, I'll start a new thread for the personal injury part of it.

Thanks again,
The Camper

Great, that's about half of your parts investment...that's about as good as you could've hoped for!

That's great! you want me to tell you why she did that? ok I will because of this..

But this is just one peice of my claim...

If you can go just a little extra when you still have a bi to settle it makes it better on everyone...if you piss someone off on their damage claim it's that much harder to settle their bi...and when comes time to settle that you too will remember that she was easy to work with and went above and beyond (she did NOT have to let you keep that rental)...

so when it comes time, I'll start a new thread for the personal injury part of it

We'll be here...listen I forgot to mention did she pay you or get you an affidavit for the sales tax? You should either be paid or get a sales tax credit or affidavit for 4300.00...let me know if you have any questions about that as well (also title transfer fees...sorry forgot to point that out to you)

Not so sure about that, this lady was only taking care of the totaled vehicle, she was from Kentucky. There's another gentleman from Ohio taking care of the rest of the claim (what is "bi"). Unless they work together?

Yes, that was included, tax, title and lein fee.

Lori,

Here's another one for you: got the official offer overnighted to me with a return overnight envelope. NO CHECK. They want me to sign the title and send it back to them. I called her up to inquire about this. When I sell somebody a vehicle, I hand over the title when I get paid, not before. She said they could not issue a check before taking possession of the vehicle.

Not sure I'm comfortable with this. Is this normal??

This is normal. Most if not all companies want that title in hand before they send out the check. If they didn't do this they would be running around chasing for titles. It seems like they have been well above board to this point, there really isn't any reason not to trust them.

I've seen adjusters trust people in the past and issues checks without having the title. It can become a real mess with their boss.

This is normal Camper...as Dasfuk has mentioned that to avoid the run around in obtaining the title from the owner the insurance companies try to secure their possession on the car before issuing the check. But at the same time I can fairly understand your uneasiness about handing over the title before receiving the claim check. However, you mayn't have another option except accepting their condition. Hope everything goes fine with the claim. Rudolph
