I'm gonna tell you straight up, without a witness, and the guy you hit not telling the truth, you're pretty much lost. How long/far ahead of you was he when he pulled into your lane? Could you not (while braking) also go right or left?

we were rear ended will stopped at a red light and my son let his insurance lapse. there is damage to his car but not the car that hit us. when i called his insurance he still hadnt put in a claim.we live in california. i understand that my son needs to get his insurance back but because we were rear ended at stop light the person who hit us is totally responsible.....correct

Mostly likely yes if you were stopped at a light. Was there a police report? You wil need to file with the at-fault party's carrier.

I live in Alabama and I was the passenger in a vehicle that was rear ended. The car that I was in was uninsured and the car that hit us was uninsured also. What should I do b/c I was hurt in the accident and I am now going through physical therapy.

Well, unfortunately there isn't much left, but sueing all partys involved...of course getting a judgement and collecting on one are two different animals.

Any chance you live with your folks and they have car(s) with insurance?
