I got rear ended in an accident with no insurance the other parties insurance won't pay for my car repairs what do I do.

You should immediately talk to your insurance company regarding this. You're not supposed to pay when you're not at fault. I think you must be having the contact details of the witnesses present at the situation. If required, talk to an attorney regarding the situation.

I have just been in an accident and not sure what to do. We were stopped at a red light about 4 or 5 cars back at 7 pm. A 2009nissian hit us from behind. We pulled off into a parking l lot and exchanged info The girl was 19 years old and handed us a temporary insurance card. Her mother arrived because the car was in her name. The mother stated she had already called their insurance company. her car was unable to drive her car away. The airbag had deployed and the radiator leaked out all of its fluid. Her suppose insurance company called to tell us she was not covered at the time of the accident. They have verified that she is currently covered by a policy but wasn"t at the time of the accident. We did not call the police because their was no dispute at who was at fault and she showed a tempoary card. Our vehile had damage to the back bumper and door and light. Also, my husband stated at the time of the accident that his back was hurting. We had full coverage insurance and the will cover the damage to our truck minus out deductible. Do we just except the estimate given from our insurance or what?? Not to sure if we have any choce.

I was at a Red light (left hand lane) on the street. Vehicle in front of me, vehicle to my right. I saw the other vehicle coming at high speed & my first though was: is this person gonna stop? My first words was to my 8 yr old daughter; sweetie, please brace yourself. Then the untinkable.. I was Rear Ended from behind. The impact was so hard that it knocked my blue tooth out my ear, & my hair out of my hair clip. First i made sure my daughter was ok, after we pulled over to the side of a business restaurant. I got all the ladies information in which she said she was at fault, but I don't have insurance, because I was planning on selling my Jeep at the end of the week. What can I do. I took pictures of both vehicles, mines are minor, but the lady's is major damage. I'm afraid because I don't have insurance, that her company won't pay for the damange. What can i do?

A temporary insurance card is issued on the day you sign the contract and it covers the time it takes for your carrier to get you the permanent ‘proof of insurance’ card. The card thus proves that the person is covered.

This is how I see it now:
It couldn’t have been that the girl was covered under non-owner’s insurance since she is living under the same roof with the person to whom the car belongs. So there are only two scenarios.

1) The girl had produced a temporary insurance card so she must have had insurance. The girl’s mother purchased insurance AFTER the accident, filed the claim and was therefore denied. In this case you need to find out about the girl’s carrier and file it against them.

2) The vehicle was completely uninsured at the time of the accident and the girl produced a fake temporary insurance card. You can get one of those printed off the internet for a few bucks. The mother lied about having called her insurance company (because she had none) and then to cover for her daughter and such future incidents, she went ahead and purchased insurance AFTER the accident and then filed the claim. Insurance coverage is not retroactive and therefore the insurance company is denying the claim.

Inform your insurance company and provide them with every little detail that you have on the at-fault party. They will investigate the matter and take care of things, including the repair works for your vehicle. If you want to further pursue the matter, you can talk to an attorney about it. As for your husband’s physical injury, his medical bills (if any) should be covered if you have UMBI (Uninsured Motorist Bodily Injury) coverage under your policy.

You are not at fault in this situation and the other party has already admitted to the fault. It wouldn’t matter that you don’t have insurance. Go ahead and file a claim against the other party’s insurance company. They will send over an adjuster to assess the damage caused to your vehicle and write you a check for the appropriate amount. There is nothing to be scared of. It’ll just take a little more time than a week to sell the car.

Remember: If you are planning to sell your car, surrender, cancel or modify your auto insurance policy on the day of the sale itself, just before you legally transfer ownership of the vehicle.

It wouldn’t matter that you don’t have insurance.


It DOES matter if you were also thinking of attempting to collect for general damages called pain and suffering. Most states have reformed this small part of tort law to prevent recovery by uninsured drivers or their passengers who are injured in a collision not their fault.

My insurance was reinstated minutes after the accident. I dont know if the vehicle that rear ened me was insured. The person driving the car was not the owner of the vehicle and the driver was not insured. Who can I get to pay for damages to my new 2012 corolla? I also purchased gap insurance from the dealer will this help me?

GAP only applies in the event of a total loss. If you were not at fault, you file a claim against the owner of the vehicle and the driver of the vehicle.

What is the Nevada tort law in a situation such as this? How do you find out if you purchased Gap coverage when you purchased your car? What if the other party has not admitted coverage, yet they rear ended you? Their insurance wants the police report before sending out an adjuster, is that reasonable? Can a police report be amended?
