After getting into a minor car accident and both parties exchange phone numbers and agreed not to notified the police, both parties left the scene. I contacted the person involved in the car accident and they were in the back of a police car reporting the accident. The officer stated that I needed to return to the accident since I can be ticketed for leaving the scene of the accident. I returned to the scene and was ticketed for failure to yield. Is this possible?

You say it happened and then ask if it's possible? I'm going to have to say, yes.

Yes... I think it probably gives this information right on the back of the ticket.

I've heard of this many many times...Did you fail to yield? The other party (sorry but rightfully so)...started worrying that things change once you leave the accident scene...(sorry but they do ALOT)...If you failed to yield then you had the ticket coming...you can fight it, but if you did it save yourself the trouble pay the ticket and move on with life...oh yeah don't forget to report this accident to your ins carrier...yesterday.

if you sincerely feel that you're not responsible for the accident, you can contest the ticket. You can hire an attorney who will guide you through the process. However, you may end up paying more as attorney's fees than the amount due on the ticket. Rather do what Lori has said, 'pay the ticket and move ahead'.

It depends by state, I think if the damaged is under 500 dollars, you dont have to report it. Seems since the other party did, you have no option but to follow suit. Seems a bit shady that you guys agreed not to say anything, but the other person went ahead to the police.

don't have to report to whom? you mean the dept of revenue? or the police?Seems a bit shady that you guys agreed not to say anything, but the other person went ahead to the police
I disagree, I think the other party was either intimidated at the scense or their better sense got a hold of them...we all know that 'proof' of ins. isn't worth the paper, and seriously you'd be surprised how often the 'story' changes after people leave the scene and talk to well meaning family and friends...this OP might've done the right thing, but the other party had no way of knowing this..Posted: Fri Aug 15, 2008 10:23 pm Post Subject:
After agreeing to exchange information and leaving the scene anyone can then call the police to report an accident. It will then make it look like you left the scene of the accident. I'll deal with the ticket but the thought of potentially getting a ticket for leaving the scene of the accident is not right.

I agree with you totally on that point..you did not just cut and run...but that also would've been easily proved...how else would you have gotten their information, had you fled? So no danger of that (leaving the scene of an accident).Posted: Sat Aug 16, 2008 08:12 pm Post Subject:
Did I have to return to the scene of the accident? Could I have just not shown up?
