roofing contract

My husband ans I signed a contract saying we would hire this roofing company if our insurance deemed that we need a new roof. I called our insurance agent and filled a claim, I called and set up appointment with adjuster, when adjuster called roofing salesman he said he couldn't make appointment. Now this is my question the roofer is coming to meet me today at lunch and he told me the contract we signed intitles him to the entire check insurance gave us. We don't even have a quote for the work from him. He says he doesn't need to give one since we signed contract. No work has been done at this time. Can we cancel contract?

The Contarctor should negotiate the calim on behalf of the Homeowner. Once the price is settled, then a Contract should be made. Most Homeowners are content with their deductible being waived. I've even upgraded shingles or certain project items for the original cost of the insurance claim, and the Homeowner still picked color and was involved with every step of the process. This is why there should be no Free Estimates, HOurs and Days wasted on greed.

First off, you will pay the same price no matter who does your roof which is the cost of your deductible. Insurance pays for the cost of replacement only. If your looking for bids lower than what insurance is paying its insurance fraud! We roofers spend valuable time & money (gas cost, estimator costs, appt time with adjuster) to give you an estimate. We are tired of doing this work for FREE! We make our living doing every aspect of roofing. You are free to speak to several roofing contractors and pick one that is reputable, but the cost will be the same. Your deductible. Anything less is insurance fraud. The reason we get you to sign a Subject-To contract is to avoid working for FREE. Check out our references before signing this contract if you are uncomfortable, but once you sign it, you agree to use us. It is only fair. How would you like to spend time/money for nothing if you had your own business????

On another note, companies like State Farm & Farmers did a study recently to find out what homeowners have been doing in regards to insurance claims for roof replacements. They found that many homeowners have been using the cheapest roofer in town, so they could pocket the difference. That is why they are paying less and your deductible is going up. At the same time, the cost of materials is going up every year.

had several roofers 2 giv estimate 1 askd 2 b here when adjuster com i signed what wuz 2 b agreement 4 that now all is dun he get higher n higher n fine print saya if i dont let him do work i pay 1000 or 20% is this legal n alabama or anywhere

Signed a contract without reading it. Was vulnerable due to a number of deaths recently. The man had a great personality and was personable. I served fruit and it was like being with a friend. Anyway I thought my husband was up on pricing and when the price was $25,000 for 3,000 sq. ft. roof. I was still numb from my next door neighbor passing the previous night. He said if we signed now he'd give us $1,500 off. I said make it $1,700 he said $1,600 then I said $1,650 and shook on it. Now I'm thinking I got took. The company has been in business for 56 years. He gave lots of other information to help cool and heat our house.

You don't ask any questions, you only make statements that mean very little compared to these six words.

You signed a contract. I'm sure that just above the place where you signed is a statement similar to this: "I have read and agree to all the terms and conditions set forth above."

What do you think the judge would say?

Yes, always wait for the insurance company to come through first. Don't pay for the roofing company and expect to get fully reimbursed later because most of the time that won't happen.

last spring I was home 8wks post surgery. Around the corner a neigh was getting a new roof. two young ladies knocked on my door soliciting their services.... said they cld have one of the wrkers come look. I thought good I can get an ESTIMATE. The guy just said yes my insurance company wld pay. The ladies said they wld call my insurance co for me (???) they left a flyer. they came can back 3x. then oneday a man came. it took me awhile to get to door cause I was convalesing. He was a roofer. I sent him away. when I went back to work he met me at the mailbox and give me his card. finailly I called the number frm the flyer the girls left. The man showed up I didnt realize it was the same people. I thought I was going to get an estimate. what I got was an inspection. Stupid me signed a contract and put it in a drawer... the roofer kept calling me inqiring if I called the adjuster yet, I finally did he met the adjuster something he insisted he shld do. Ok now I asked him how much is the job going to cost? He very rudely said that I signed a contract to pay him whatever the insurance company wld pay me. and that he wld sue me. I said the I felt threaten and duped and hung up.
he called back wanting to come to my house. I had chest pains, He said he was sorry and the he wld not sue me. I said I still felt duped and how dumb of me to sign a contract saying I'd pay u whtevr insurance say w/o even having a estimate of what the job cost. that he wld gave me some of the check if I was having financil issues. Uggh. I'm done with him. a few days after that meeting on my porch, he send me a letter frm his lawyer's office saying that he wld sue me. In the meantime I've gotten several estimates frm other roofers.
they all give me a written proposal and said plz call if I USE them. I do not want to wrk w/ someone like the 1st roofer. I dont care about him giving some of the insurance check back. I cant see how this can end good w/ all the bad tht's passed and the job has not even been started. I havent had my roof fixed yet cause not sure if I'll be paying twice... Plz is there anyway out of this Storm Chaser contract.

Possibly. A contract is a contract . . . except when it is created under false pretenses or through the use of material misrepresentation or artifice.

As a signer of the document, you have a responsibility to have done what your signature confirms: That you have read and understand the contract, and that you agree to each of its terms and conditions. It's hard to argue against that in most instances.

If you could show that this company and its "agents" did the same thing repeatedly with other consumers, you would have a better argument.

At this point, you should simply ignore the letter threatening to sue. Wait until it actually happens. If it never does, your troubles are over.

If you are sued, then you will have to defend yourself (or hire an attorney to do that for you), and you will force the contractor to defend his actions in court. He may not want to expose himself to that, which is why you may never be sued. It's hard to justify such conduct which is not an acceptable business practice.

If your roof actually does need to be repaired due to insured damage, then choose a contractor you feel comfortable with and have the work performed. You have a responsibility under the terms of your homeowner's policy to do that.
