i was hit by hit and run driver who ran stop sign. police caught him.he was driving uncles car.no proof of insrance was found.i was taken to emergency room by ambulance. was sent b ills totaling over $1400.my insurance company sent mecheck for $1000 telling me to pay the medical bills with it.incidentally i had only liability on my car so my car is still damaged.damage over$700

Did they eventually find and charge the driver? You likely had only 1k limit on medpay coverage that's the thousand you got. But what about an Uninsured Motorist (b.i.) claim? Did you file one, did they talk to you about one? Other driver or owner either have insurance? What state are you in? What do you want to sue your company for? Lot's more questions need answered please, then I'm sure we'll be able to assist you.
ps I don't know WHAT this prior post is about. :?

I agreee not sure on the other post there.....but I have to agree with Lori on this one...can you look at your policy and tell us what kind of coverage you have and what state you are from?

First of all, this doesn't mean that there was no insurance on the car based on the post language. It said that "no proof of insrance [sic] was found." So...did you actually find out if there WAS insurance on the car?

Secondly, we definitely need to know what state you live in, and the medical payments or PIP coverage amounts listed in your policy. Look at your auto policy and see what it says. Your state of residence is key here, as Lori appropriately pointed out.

Do you have Uninsured Motorist Property Damage (or UMPD) coverage on your car? It just might be there depending on where you live and the coverage that you purchased. This will pay for the damage caused to your property by an uninsured (and possibly underinsured) motorist. There's normally a deductible attached to UMPD in most states, so check on this, too.
Lastly, any clue on whether the guy who hit you was driving his uncle's car with permission? That could be a key component as well.

In answer to your question, yes, we can sue anyone over just about anything.
In your situation if you desire to sue anyone, it probably should be the other driver. You say they caught the other driver, so are we to assume that a citation was written?
You say that you have Liability Only coverage, if that is the case you may have been paid all that your insurance company is required to pay.
As everyone else has said, we just don't have all the particulars.
Some states require that you either accept or reject Uninsured Motorist Bodily Injury Liability (UMBI) and Uninsured Motorist Property Damage (UMPD) at the time you bought your auto insurance. We don't know what you did at that time?
If you in fact selected one or both of the above coverages, you have a claim. If you rejected them, you do not.

i can just say if ever had a car insurance u should definetly sew the driver that had hit u .now ur situation in here suggests that the police caught the driver .............................
so are we to assume that a citation was written? and also the drivers identity shld also be there u can definetly ry as i feel

from chicago illinois.have UMBI$20000-$40000.did not file uninsured motorist claim.have limited info on teendriver who had no ins.have uncle address but no evidence of insurance.teen was charged.yes ionly had $1000 med coverage.
