I got rear ended in an accident with no insurance the other parties insurance won't pay for my car repairs what do I do.

Shondrell - help us understand. You had no auto insurance at the time of the incident and the other party's insurance won't pay? If that's the case...

Most of the time, when you are rear-ended and there are no other vehicles involved in the collision, the person who rear-ended you is at-fault. However, if that other party's insurance company won't pay for your repairs, then you have a problem. Normally your insurer would be discussing it with their insurer. If that's not an option, you should be on the phone trying to get a resolution. They may not be very helpful if you're not insured. Depending on the expense of repairs, you may consider talking with an attorney about the situation.

OP, first I'm sorry and don't know how this thread hasn't been addressed till now! :shock: anyway...if you are uninsured, that makes no difference as to the other (at fault) carrier address your damage, unless of course that party also is uninsured...wouldn't that be a hoot....you don't say 'why'

We need to know that in order to help you with this...and what state are you also have they denied your claim in writing? if so the reason will be in the letter...tell us what it says.

Yes Lori they did send a letter saying that they weren't responsible for the damages because of a car cutting me off and I had no choice but to put on the brakes and that's when the car slapped the back of my car spinning me around in traffic. Did you say you can help me?



Was your car stopped when this person hit you in the rear? and was the hit dead in the rear of your vehicle? What type of street or roadway were you on? Do you still have the letter? Please type word for word what it says, because this makes no sense UNLESS your vehicle was out of control and maybe in another lane when you were rearended..was there a police report? What did it say? Who got a ticket? Please provide the answers to these questions (here in the thread so others may respond as well should they chose to)...and we'll see if we can't help you...also when did this happen and what state are you in?

I'm in the state of Florida and the police report just said that a car cut me off and he rear ended me. And yes I was stopped and I was turning left on 132nd and 27th avenue. No he hit me as I was getting in the turning lane and his defense was that it was raining and he had no choice but to hit me. He hit me on the left corner rear area spinning me around several times

Shondrell, pls do exactly what lori has said, re-type the letter, which you have received from the insurance company, word by word to help us understand the situation better. From your description it seems that the other driver didn't slow down before colliding with you. If he had any chance to avoid the collision but didn't react promptly, he is at-fault.

Well, since Florida is a no-fault state & the no-fault law applies to the bodily injury claims, the at-fault driver may avoid paying compensation for the medical expenses. He is, however, responsible for the property damages caused to the vehicle.

Anyways, I'm confused about their reason for denial, may be there is something more in the letter that you have missed in your post.

There defense really probably is that you pulled infront of him cutting him off giving him no ''last chance'' to avoid the rear ended accident ...is that it? from your discription and damage i'd about bet on it...and if you were still moving into the lane, and your impact seems to support that, then the other driver isn't likely at fault...

I was hit from behind at the end of July.by a company vehicle we were doing 65 miles an hour never changed lanes never slowed down it was after 9:30 pm when the young man hit our older conversion van thankgod it wasnt the small car.when we pulled over the kid kept apologizing he had fallen asleep at the wheel he had to have been doing 80-85 miles an hour.
my problem is due to the economy and my fiance being hurt at workand now on workmans comp/california,We had no insurance.

I'm in a 3 lane highway, I'm all the way to the far right. The car in front of me pulled from the middle lane and tried to pull into a restaurant blocking the lane, I'm going the speed limit, as soon as I saw him, I hit the brakes, the road was wet, so I'm sliding and I hit him, in the back corner. Talked to the insurance, and because I hit him from the back, I'm at fault, and I gotta pay a 500 deductible, nobody stopped, no witnesses, is there some other way for this to be disputed.
