Should I admit at-fault to my own insurance company

Dear Friends,

I am so happy to have found this place, could anyone please help me.

I recently has a collision with another vehicle, it was a rainy day with bad weather condition, the car in front of me stopped so hard and sudden without any previous signs, I stepped on my break hard, but I still skid onto the rear of the other car's bumper, both of our cars only had minor damage, no bodily injury of course.

The other driver reported to both her own insurance company and my insurance company, I was going to report to my insurance company as well, but she did it the next day and when I called my insurance company the day after, the claim was already there.

My insurance company asked me if I am willing to accept fault and liabiliy on this car collision.

Is it true that I am fully at fault in this incident? I was maintaining a long distance from the other car, but the other driver stopped so suddenly, is the other driver particially at fault as well or do I have to admit full fault?

If I do accept fault and liability, is there going to be any bad affect on my part, because I have never had any car accident in 13 years of my driving life, I am not sure what to do?

one more question, is there a time frame that I need to respond to my own insurance company to accept fault? I am in California.

If they have (or will be) paying for the other parties damages and injuries you have already eclipsed the 'at fault' or 'chargeable' threshold and will see an increase in your premium...using your collision coverage on this same accident will more than likely not cause any more increase. If there were going to be NO payments on this claim other than your vehicle repair, different story, but that is not the case as I understand it....Use the money to fix your vehicle....(my opinion)..

Re the other carrier getting your address...this really isn't that big a deal, if I knew your true name, and city/state I could in about two shakes get your address too....and even more info if I wanted to pay for it...it's the way of the world now.

Re: the other company contacting you...they still need to get your side of the facts of loss, if you don't want to talk to them you don't have too, personally I never understand this stance, and rarely have a claimant that won't discuss the accident....but ultimately of course it's your decision.

But after I went for the car damage estimate, my own insurance company gave me a check (of couse minus my collision coverage deductible) and said that they will pay for my car damage because I have collision coverage,



If I cash the check, are there any regulations or other consequences that I need to be aware of?

no, not really, is the draft made to you only? or to you and a shop or you and your lein holder? (also it's most likely a draft NOT a check remember that if you plan to use the funds for something other than the repair)....If it is made directly to you, then you may do what you want with it, if you do not repair your vehicle (which is your right) then should you have another loss with damage in the same area it could be deducted from that settlement that's really the only thing.

Since I will be at-fault in this rear-end bumper car accident and there was no police report taken at the accient scene. Will I still get at-fault points in my DMV record? ( I am in California).

If I will get at-fault points in my DMV record, does anyone know who will be reporting the at-fault points to my DMV record? my insurance company? the other driver's insurance company? or others?

How long will the at-fault points stay in my DMV record? will I be able to clear the points just like if you go to a traffice school to clear your traffice ticket points?

no you will not....if there was no police report then this would be impossible....which renders the rest of the question moot.
