Car accident and Javitch collections

My son was in an accident driving my car. The car was insured but my son who 20 was not insured to drive my car. The other car, the lady who was driving was not insured but her husband was insured. The Javitch people have called and are looking at collection 3600 for this accident. I spoke with them and offered to make payment arrangements as this is my son and they refused. They have sent me a letter giving me 7 days to make the payment or the matter would be forwarded to an attorney in my local jurisdiction. They said they would suspend my drivers licence. Are they talking about my driver's licence or my son's? What should I do since I dont have this kind of money to pay.

Who's license depends on the state laws. Some states allow the owner and driver to be held liable. In that case, both could be suspended. Other states, only the driver can be held liable.

There are many attorney firms where they pretty much just do collections. They are little more then a glorified collection agency (just with pretty letterhead).

I take it that you submitted the claim to your carrier and it was denied in writing?

When the attorney contacts you, ask about making payments.

Also, have you reviewed the paperwork to make sure the amount they say you owe is correct?

Lastly, you son is 20 years old. I'm hoping he's contributing to the payment.

Thank you. I already contacted the attorney and they refused to make payment arrangments with me. They said they wanted the amount in full or a lawsuit - words from the attorney. The letter following the telephone discussion is now saying I have 7 days to come up with the money. How do I handle this, I am at a loss and what is the next step that they will take or I should take to get more time if they are refusing working with me. Help.

First, I cannot know what they are going to do but I _highly_ doubt the attorney is going to file a suit. There is really no point. That would only get him/her a judgement and would eat up a lot of time (time=money). I _really_ think that is just a threat (typical). If the attorney filed suit on every collection they received, they might as well set up an office in the court house.

As I mentioned, many carriers turn over almost all their subrogation claims to attorney or even sell them.

Have you filed a claim under your policy?

Yes, I did file a claim with my insurance and because my son was not included in my insurance, it was declined. What you are saying makes a lot of sense about the threatening. I will continue calling them to see if they can make payment arrangements with me. I will be persistent. Thank you again.

Was the denial in writting? It's not a denial until it's in writing. Some states its difficult to deny a claim, especially if the owner can be held liable.

This is an update to the case. The payment arrangements has been made and the first person I spoke with with the company was not a nice person and the greatest thing is there is always someone who is willing to help and has great customer service, and his name was Michael. He worked with me and was very helpful and thank you so much for your help Tcope. This is a great site and I am recommending it to family and friends.
