Statement changed from police report

I was backed into in a parking lot when I car pulled into a spot and I proceeded past (this is a 2 lane parking lot), the other driver then proceeded to back up to get in another spot across the lanes and hit me in the rear behind my door. Since this was private property, no tickets were issued and statements from both of us were taken. Upon receiving the report both statements matched. Stating what I said above and the other driver said that they pulled into spot and proceeded to back into another spot and hit my car. I have contacted their insurance and they have came and looked at my car. I called and they now say that the other driver is now changing their statement and have 2 witnesses who were in the car at the time. These statements were written by us both and translated on the accident report. My question is they want me to fill out another accident form stating what happened and fax it back to them and then they would investigate. What should I do?

The situation seems a bit tricky out there for you right now. So, I'd rather suggest you not to take a step further in the direction that they want you to. At this juncture, you may at the most consult an attorney or visit the state DMV office with a copy of the police report & a photocopy of the statements that you have with you. You may forward these documents at the office & seek their help in this regard. Also, I'd suggest you to forward a copy of the said docs (attested by an experienced attorney) to the other carrier along with which you would need to attach a letter seeking their reason to discontinue this investigation on the basis of the police report clubbed with the initial statements. I'm sure, your case needs special attention!

Yeah, I also feel quite the same way as Fatman, except that I'd take a chance myself by submitting my letter(supported by assoc docs) with their insurer before I'd move to an attorney. Hiring an attorney is not easy for all at every instance of such cases. Seeking professional assistance is the lender of the last resort.

Well as far I understand things...I feel your statements have already been submitted at the State DMV, even though tickets were not issued to you two becoz of the properties being pvt. So, once you pursue the case it would automatically get verified with the statements that are present with the authorities already. Hope thats helps you

Well, this happens more than you'd think. Their problem is three fold, first the physical damage will be obvious to the adjuster what happened. I love these types of claims because they are soooo easy. Any witnesses in a vehicle are not considered (by adjusters) to be 'independent' and believe me their 'statments' won't carry too much weight. And they've
'changed' their story, never looks good to an adjuster... You didn't say 'how' their statement had changed.

I certainly wouldn't hire an attorney, cost way too much for such a small claim, more than likely more than your damage!

You have two choices you can fill this out for them. And talk to the adjuster, we'll be glad to help you if you want to come back and tell us any trouble you are having. Or go to your carrier, if you have collision coverage they will repair your vehicle and subrogate the other company,(including your deductible) if you have not reported this to your carrier you need to do so RIGHT NOW! They will need to investigate it because apparently they other party is attempting to lay some blame on you, and your company needs to deny them (offically) once they complete their investigation.

Please let us know.......and don't forget.....turn your claim into your company asap!

Thanks for all the info. I took this to my insurance carrier yesterday and let them look at it. They said to fax it back and see what happens. They will not let anything through from the other party since of the obvious police statement. When I asked how the story had changed with the other insuance adjuster, he would not say. He was waiting to our additional statement I suppose. I will keep you updated on what happens.

I just got a call today from my insurance co. saying that I had a someone filing a claim on my policy. When I told them what happened. They stated that do not think anything can come from it but, they have to come out and take pictures so they can see the damage. This is crazy. I have still not heard back from their insurance co. yet and now they are trying to file a claim through mine. ARGH! Said that i motioned them to go and them speed up and went behind them and they hit me. Yea like I would do that, that is just crazy.

That is almost funny, if it weren't for the frustration involved... Take comfort that your company is investigating, and responding quicker than her carrier. You haven't heard anything from them? How long since you reported it? Call them again, find out the adjuster it has been assigned too, and ask 'where they are' on their investigation......keep us updated, i know it's frustrating! :evil:

I posted about this in the other post and wanted to reply that this was the same incident. They still have not payed me for the car. They are giving me the run around. How long can they do this?
