My husband elected to leave his job and did not fill out paperwork for the insurance by the enrollment date. The date to file by was 12-21-08 and it is now 01-02-09. He was working at EA Scripps Co.

Please, elucidate your query bit more. Are you wondering whether or not your husband will qualify for a health plan since he has left his job?

Collin, if your husband has missed this open enrollment he may have to wait till the next session starting at the fall. Also, he if joins another company he may get the chance to enroll with the employer group health plan in the thirty days period available for the new employees joining the organization.

Your question is not real clear??
It appears that your husband terminated his job with the EA Scripps Company and did not complete the enrollment forms within the time frame given, to apply for the extension of his Group Health Insurance and go on COBRA? You have indicated that the cut off to apply for COBRA was on 12-21-08.

Your husband has 60 days from the date of termination to apply for COBRA. Is 12-21-08 the date he terminated his employment? Or is 12-21-08 the 60th day from the date he terminated his employment? This would mean that his date of termination from EA Scripps was around the 19th of October. Again he has 60 days from termination to exercise the COBRA extension of Group Health coverage. Most employers will send you Certified Mail about the COBRA option.

Does your husband or anyone that was covered by your husbands Group Health Plan have any pre-existing medical conditions that require current treatment? Has your husband taken another job and if so when will he qualify for Benefits.

If his Group Health coverage lapses for more then 60 days the new Group Health Plan would have a 12 month waiting period before covering any pre-existing conditions anyone may have.
