Mom passed away recently and her husband may have a life insurance policy on her that we are not aware of.

You can try the Medical Information Bureau's Lost Policy Locator service ( http://www.mibsolutions.com/lost-life-insurance/ ). They might be able to tell you the name of any insurance company your mother applied to. Then it's up to you to follow up with the insurance company.

Look for some documents that will prove that you mother indeed has insurance. Also, try to talk sincerely with her husband.

I am going through the same thing at present, well not exact. My father passed away and his documents were not in order. We located his policies through looking for premium payments through his check register. Just a suggestion.

First policy terms should know. Policy holder may be expired, concern nominee should approach to lic office.

My mother passed away July 2008 and she was a retiree of the state of NY. She had a policy with them but when she passed and I called them they said she did not have a policy with them is there any way to find out if she had a policy anywhere.

It is unlikely that a "retiree" of the state of NY would have had life insurance coverage provided by the state. She may have opted for conversion coverage from the state's group insurance provider, but probably did not due to the extreme cost that would have meant.

If you know which insurance company provides the group life insurance benefit, you can contact them directly to inquire. If your mother had an individual policy there may be a record of the application for it on file with the Medical Information Bureau. They DO NOT have information about group life insurance.

You are asking a question SEVEN years after the fact. Why has it become important now, in 2013, when it wasn't important in 2005?

Address your question to the insurance company, not us.

My Grandmother took a life insurance policy on her daughter, my mother which passed away in Dec 2012. My Grandmother recently passed in July 11th. My question to you would be since my grandmother was the holder of the policy and she has passed as well who would that money go to. My Grandmother does have a will but the attorney is the one in control of that. My grandmother had a boyfriend that states he gets all her money and I am just concerned he might try to get her policy and others that were suppose to go to my mother until she passed

If your grandmother was the beneficiary of your mother's life insurance policy, then Granny was supposed to have received that money. Whether it was ever paid out or not, it remains Granny's money because mom died first.

If Granny never collected the money, it remains payable to Granny's estate, and the attorney will file a claim for those proceeds. The estate will be divided according to Granny's will and state law.

Whatever was "supposed to go to [your] mother" is long gone, because she died before Granny. Any property remaining in the name of your grandmother is now part of her estate, to be disbursed according to her will and state law.

As a potential heir, you have a legal right to see a copy of the will. You can decide what course of action to take after seeing the will. A will becomes a public document in a probate action, and anyone can see or have a copy of it at that point. Only when the estate is very small (about $50,000 or less and with no debts to resolve) will probate not be required.

If you don't believe the attorney will handle the affairs of the estate properly, then you need to hire your own legal counsel to represent your interests -- which may be zero. Your legal fees will be at your own expense, win or lose, unless something unlawful was about to happen and your attorney stops it.
